Shocker for India's solar sector: US slaps 123% anti-dumping duty on imports
The United States Department of Commerce on May 3, 2024, imposed a preliminary anti-dumping duty of 123% on crystalline silicon photovoltaic cells and modules imported from India. This significant tariff also included a finding of "critical circumstances," signaling the Department's belief that a surge in imports or continued dumping could occur before a final determination is reached.
This preliminary ruling stems from an ongoing investigation initiated in November 2023. The investigation commenced following a petition filed by domestic U.S. solar manufacturers, which alleged that solar products from India were being sold in the U.S. market at prices below their fair value. Such practices, known as dumping, are considered unfair trade and can harm domestic industries by undercutting local producers. The 123% rate specifically applies to solar imports from Indian producers found to be engaging in these alleged dumping practices.
The declaration of "critical circumstances" holds particular importance as it allows for the retroactive application of these duties. This means the tariffs can be applied to imports up to 90 days prior to the preliminary determination date, potentially covering a period from early February 2024. This measure is typically invoked when there is concern that importers might increase shipments to avoid impending duties, or when there's an unusually large increase in imports suspected of dumping.
The decision carries substantial implications for India's burgeoning solar manufacturing sector. The imposition of such a high duty can significantly increase the cost of Indian solar products for U.S. buyers, potentially limiting market access and disrupting established supply chains. Vikram Solar, a prominent Indian solar module manufacturer and exporter, is among the companies directly affected by this preliminary ruling. Industry representatives in India have already voiced concerns regarding the potential adverse effects on trade relations between the two countries and the overall viability of their solar exports to the U.S. market.
In addition to the anti-dumping duties, the Commerce Department also issued preliminary countervailing duties (CVDs), often referred to as anti-subsidy duties, on Indian solar imports. These CVDs range from 4.71% to 15.22%. Countervailing duties are imposed to offset any unfair competitive advantage gained by foreign producers who benefit from government subsidies. The combination of both anti-dumping and countervailing duties further elevates the cost burden on Indian solar exports to the U.S.
The U.S. solar industry has a history of pursuing trade remedies against what it identifies as unfair competition. Similar anti-dumping and countervailing duties have previously been applied to solar products from other countries, notably China, and more recently, investigations have targeted imports from several Southeast Asian nations. These measures are designed to safeguard domestic manufacturing capabilities and foster a level playing field for U.S. producers. However, they can also introduce volatility and increased costs for solar developers and consumers in the U.S. who rely on imported components for large-scale solar projects.
This determination remains preliminary, and the U.S. Department of Commerce will continue its investigation. Final determinations on both the anti-dumping and countervailing duties are currently anticipated in the fall of 2024. Should the Commerce Department's final findings affirm the existence of dumping and/or subsidies, the case will then proceed to the U.S. International Trade Commission (ITC). The ITC will be responsible for making a final determination on whether the dumped and subsidized imports have caused, or threaten to cause, material injury to the U.S. domestic industry. An affirmative injury finding by the ITC would lead to the imposition of definitive duties, cementing the tariffs for a period of several years.
