The South Goa District Consumer Disputes Redressal Commission has directed Ola Electric Mobility Pvt Ltd to refund the cost of a faulty S1 Pro electric scooter and pay significant compensation to a customer. The ruling, issued recently, mandates Ola to refund Rs 99,999, the original purchase price of the scooter, and an additional Rs 1.04 lakh covering compensation, litigation costs, and accrued interest, citing "deficiency in service" and product defects.

The complainant, Edwin Mascarenhas, purchased an Ola S1 Pro electric scooter on May 16, 2022. According to the complaint filed in August 2022, the vehicle experienced "major manufacturing defects," including a "faulty battery," and suffered "multiple breakdowns" within months of its purchase. Mascarenhas reported that the scooter became inoperable, prompting him to seek redressal from the consumer commission.

The commission noted that despite Mascarenhas repeatedly raising concerns about the scooter's performance and functionality, Ola Electric reportedly failed to provide adequate after-sales service. The complaint highlighted a lack of proper attention to the grievance, alleging "negligence and deficient service" on the part of the manufacturer. Mascarenhas sought a full refund for the vehicle along with compensation for "mental agony, harassment, and loss of use."

Ola Electric, in its defense, contended that any problems with the scooter were due to "wear and tear" and the customer's alleged "carelessness" in handling the vehicle. The company denied the existence of manufacturing defects. However, the District Commission rejected Ola’s arguments, asserting that the manufacturer "failed to provide proper service" and that its actions constituted a "deficiency in service" as defined under consumer protection laws.

The Commission's detailed order includes the following financial directives:

  • A full refund of Rs 99,999, representing the purchase cost of the Ola S1 Pro scooter.
  • Interest at 10% per annum on the refunded amount (Rs 99,999) from the date of purchase (May 16, 2022) until the date of payment.
  • Rs 20,000 as compensation to Mascarenhas for the mental agony and harassment experienced.
  • Rs 10,000 towards the costs incurred for litigation.

The total amount payable, comprising compensation, litigation costs, and accumulated interest on the refund, is stipulated as Rs 1.04 lakh in addition to the principal refund of Rs 99,999.

This ruling underscores the growing importance of consumer protection in the rapidly expanding electric vehicle market, particularly concerning product reliability and after-sales support. It highlights the responsibility of manufacturers to address manufacturing defects and provide effective service to customers. The decision by the South Goa commission may set a precedent for similar cases involving electric vehicle defects and service deficiencies.

Ola Electric Mobility Pvt Ltd has been given 30 days from the date of the order to comply with the commission's directives. Should the company fail to adhere to the ruling within the specified timeframe, the complainant retains the option to approach a higher consumer commission for further action.
